By booking, paying for, or participating in swimming lessons provided by SwimEase Swim School ("Company," "we," "us," or "our"), you ("Client," "you," or "participant") agree to be bound by these Terms and Conditions. Failure to comply may result in termination of services without refund.

 

1. Acceptance of Terms

1.1 These Terms constitute a legally binding agreement between you and SwimEase Swim School.
1.2 By booking lessons, you confirm that you:

• Are at least 18 years old.

• Have read, understood, and agree to these Terms.

• Have authority to bind all participants (including minors) to these Terms.

 

2. Services and Obligations

2.1 Booking and Payment

2.1.1 Lessons are confirmed only upon full payment or a non-refundable deposit (if applicable).
2.1.2 We reserve the right to refuse service for incomplete payments, unsafe conditions, or other reasonable cause.

2.2 Cancellations, Rescheduling, and No Refunds

2.2.1 Cancellation by Client:

• Cancellations or rescheduling requests require 48 hours’ written notice.

• Failure to provide notice results in forfeiture of all fees for the scheduled lesson.
  2.2.2 Cancellation by SwimEase:

• We may cancel due to instructor unavailability, safety hazards, or force majeure (e.g., extreme weather).

• A makeup lesson or credit will be offered; no cash refunds.
  2.2.3 Strict No Refund Policy:

• All payments are non-refundable, including but not limited to:

  • Client no-shows, late arrivals, or early departures.

  • Dissatisfaction with lesson quality (see Section 2.5).

  • Pool conditions rendering lessons unsafe (e.g., improper temperature, hygiene, or maintenance).

  • Termination of services due to Client breach of these Terms.

 

3. Client Responsibilities

3.1 Punctuality

3.1.1 Lessons start and end at the scheduled time. Late arrivals will not receive extended sessions.
3.1.2 Repeated lateness (3+ instances) may result in termination of services without refund.

3.2 Pool Requirements

3.2.1 Temperature:

• Pools must be heated to 28–32°C (82–90°F). Instructors will test temperature upon arrival.

• Failure to maintain this range permits immediate lesson cancellation with no refund.
  3.2.2 Safety and Hygiene:

• Client is responsible for ensuring:

  • Safe chemical balance (e.g., pH levels between 7.2–7.6).

  • Clean, debris-free water and pool area.

  • Functioning pool equipment (e.g., ladders, drains).
    3.2.3 Access:

• Client must provide unobstructed access to the pool area. Delays exceeding 15 minutes forfeit the lesson.

 

4. Health, Safety, and Liability

4.1 Health Disclosures

4.1.1 Client must disclose all medical conditions, allergies, disabilities, or behavioral concerns (for minors) in writing before the first lesson.
4.1.2 Failure to disclose relevant health information voids all liability claims against SwimEase.

4.2 Assumption of Risk

4.2.1 Participation in swimming lessons involves inherent risks, including injury, illness, or death.
4.2.2 Client agrees to assume all risks and releases SwimEase from liability, except in cases of gross negligence or willful misconduct.

4.3 Limitation of Liability

4.3.1 SwimEase is not liable for:

• Injury, illness, or property damage arising from participation in lessons.

• Acts or omissions of Client, third parties, or uncontrollable events (e.g., weather).

• Loss/theft of personal belongings at the lesson location.
  4.3.2 Total liability for any claim is limited to the fees paid for the affected lesson.

 

5. Termination

5.1 SwimEase may terminate services immediately for:

• Breach of these Terms.

• Unsafe or abusive behavior toward instructors.

• Failure to pay fees.
  5.2 Termination voids all future lessons without refund.

 

6. Dispute Resolution

6.1 Mandatory Mediation/Arbitration:

• Disputes must first be submitted to mediation in [Your Jurisdiction].

• Unresolved disputes proceed to binding arbitration under [Arbitration Body Rules].
  6.2 Governing Law: These Terms are governed by the laws of [Your State/Country].
  6.3 Waiver of Class Actions: Claims may only be pursued individually, not as class actions.

 

7. Miscellaneous

7.1 Entire Agreement: These Terms supersede all prior agreements.
7.2 Severability: If any clause is deemed unenforceable, the remainder remains valid.
7.3 Amendments: We may update these Terms at any time. Continued use constitutes acceptance.
